COULD I CUT LIKE AND 1" SLIT OUT OF MY FRAME ABOVE MY AXLE FOR THE CLEARANCE ON MY RIGID REAR IN FOR CLERANCE AND NOT HAVE FRAME STRENTH PROBLEMS?

cut it and box it back in

Or go buy 3in pipe at a local metal store. Cut it in half and you just made a baby c notch that you can weld in. You might want to get some 1/4 plate just to plate the top of the frame rail for added support.
