selling a truck, with no title?

need some help here.

i traded trucks with some 17 year old kid a few weeks back. he was supposed to mail me the title, and 700$ cash. after several emails back and forth, he finally mails me 300$, and his title. now, i still have the title to the truck he got from me, but im refusing to give it to him till i get the rest of my cash. but now, hes selling the truck to someone else. is that at all legal? just looking for someone elses input.

nah, he cant sell it without the title...unless the kid he sells to is a dumbass

This sounds like an all around bad situation. While you left the title in your name you left yourself open to lawsuits if he wrecked into something.
As far as him selling with no title that is an area I am not so sure about. As you allowed him to take posession of vehicle he probably can sell it not sure.
Good luck getting this issue resolved.

thanks kyle. hes selling it to someone in Aftermath GA. i even have saved convos that hes "ripping someone off".

i know its a real bad situation. i just trusted someone way too much, and it got me here.

If you havent transfered the title into your name, he can still get an affidavit of lost title and sell it that way...then you're fucked. If the truck is in your name now though, he cant do shit..it's your truck...

Well, if you have the title and he owes money on it you have the right to the vehicle. If he sells it to someone and they try to file anything on it they cant get the title until you release it. Im a dealer and thats how it works in Texas.

yea, its in my name. should i get it out of my name? there is no insurance on it or anything.

if it's in your name, get the cops to go over there with you and pick it up...

if he has it in his possession 6 months, he can apply for a storage title. Then he is allowed to assess storage fees of about 20 dollars a day for 6 months, about 3600 dollars, and if you want to continue to own the truck you will have to pay it and any more incurred until you pick it up.

Possession is 9/10ths the law. The guy with the truck and the keys can ALWAYS get the title, the guy with the title can almost NEVER get the truck or the keys unless it was stolen. If you have a verbal sales agreement and he has the truck, it is your word against his for the balance of payment and he will likely win if he insists he paid. The judge will say "why would you give him the truck without payment in full?"

I usually give the title without signing it as a show of good faith for this reason. I never give a truck without payment in full though.

well, hes only had the truck for less about a month. so im basically screwed?
