Like mr900f says, the law just dictates the maxium distance the mud flap can be above the ground. So make you an itty bitty flap and set it at that height, if they want to give you tickets, carry a copy of the code to court and a nice clear picture of a ruler showing the length from mudflap to ground, and tell them to suck it.
It's funny that the law says 8" but with a 4" tolerance. So you could have mudflaps up to 12" off the ground...how stupid.
I will tell you that if I wasn't careful I was always snatching mudflaps off the wrecker. They were a decent height unloaded, but pick up something heavy while backed up to a curb (snatching, so you have to be quick) when you load the bed down, the mudflap would catch on the curb and rip right out when I pulled away.
I slapped mudflaps onto the 3500HD even before it had a bed, so I wasn't raining rocks on people behind me, and so I wouldn't get tickets. Had to be careful though because with no bed, it could easily sling something right into my rear window. Was also bad about mudding up the mirrors when I'd leave the scrapyard.
