so on sunday i went to take my truck for a test drive after finally getting everything fixed and back together. well i was about to get on the highway when i saw a woman stranded in the middle of the road on the feeder. so i pulled over to see if she needed any help. well, i popped the hood and saw the problem immediatelt, cracked radiator. i told her about it and she called for a ride. she had her grandson with her so i offered to take her and the car to my house and replace the radiator for her. she accepted. i told her that i wouldn't charge her anything just get the parts and i would take care of it for her. well she finally showed back up tonight with her dad and husbad or atleast i think it was her husband. i get the radiator swapped and we went ahead and changed out the thermostat as well. started filling it up with water and it started pissing everywhere. i believe it is a blown head gasket. we got to talking and come to find out she has only had the car (95 Nissan maxima) for about 3 months now. then they told me about all the problems that it has had. so i told them about the lemon law. well we ended up loading it up on my trailer and i towed it back to the lot where they bought it from and we dropped it off. she talked to the owner for about 10 minutes and came back out. i won't find out what is going on until later but they are getting screwed! they told me that when they bought the car the radio did not work and that they had to pay the lot that they bought it from to get it working. then it had to have all new brakes installed. then this, and when i crawled underneath it to look for the leak, it also needs new belts and hoses. plus she got in a wreck with it and the insurance company wrote them a check for 1300 bucks but they put the check in her name and the guys name that she is buying the car from. the guy she is buying from wouldn't sign the check and give it to her, instead he kept the check and the money from the accident. how the hell is that even legal? it's isn't my business but damn i hate crooks!

its leagal because the car isnt paid for yet he is still the leagal owner and as far as i know the lemon law only applies toward new vehicles...thats why they have the no warrantie papers you have to sign to buy a used car...sorry for her troubles but she really should have had a mechanic look the car over b4 she bought it.....and a 1995 car is 13 years old..soooo gotta be very careful

yeah, i did what i could. it just sucks that they are getting screwed. i don't see how it could be legal for him to keep the check though. when you buy a car from a dealer and you get into a wreck, the dealer doesn't get the check, you do. so i don't know how that is legal. but like you said, it is an old car and you gotta really know what you are buying when you are buying that old. just sucks cause they are very nice religous people that don't have a lot of money.

my sister was involved in a serious accident and since she wasnt the legal owner of the car she didnt get a dime for the car justthe medical bills and settlement she was out of luck on the car

look at it like this if you sold some one a car on payments...they made the down payment and say one payment after that then totalled the car and still owed you money you would want your money...not trying to sound like an azz just trying to explain how it works

yeah, i see what you are saying but when you buy from a used car lot i figured it would be different. but then again, i have never bought from a used car lot for these very reasons. hahaha

Mad props to you for being an awsome citizen.
As far as the check goes... Most the time with newer cars the ins company will only give the check to the body shop. This is to protect the lenders. If the car does not get fixed and the person does not care and fails to pay the car they get to repo a scrap car. They get nothing on the auction block and the odds of the person giving a crap if it screws their credit is slim to none. So in this case it is the original owner that is the lender.... He can then choose what to do with the money. All he has to do is say that he applied it towards the balance. Sucks either way. I wish them luck and would like to give you the Key to Troy Texas for doing a tremendous act of selflessness.

props for being the good guy you are and helping someone out. That definetly sucks with their situation though. That has more twists and turns than a rally stage.


I had a similar problem with my Catera when I bought it last year. I bought the car from the dealer who had it safety inspected and emission tested for me,at an extra $500 cost,since the car did need some work to pass inspection. From the day I picked it up,I had several problems,but the dealer was 2 hours away from my house. After about 6 days I was fed up with the list of problems my car had and I wanted to get rid of the car and get my money back. We paid for the car in full with a certified check and they would not refund our money and take the car back. Instead,they were willing to fix the car and they spent almost $3000 out of their own pocket to fix it...basically,my trying to make me happy,they lost money on that car.

However,the car was nothing but problems,so I ended up selling a $6000 car for $800. It was so bad when I sold it,the guy had to trailer it home because it would barely drive up and down my street.

So yeah,it sucks do deal with used lots because lots of them are pretty crooked and will do anything to make a quick buck to pay the bills and pay themselves.

Hopefully things can get straightened out in their car situation and they're rolling again. Sucks to get caught up in other people's problems like that though.
