What to do in this situation?

So this isent generally about mazdas but it is automotive, heres the story...


So my buddy lives in an apartment building and his father was driving the caravan down the ramp to the underground this morning and smashed the wall pretty hard and scrapped down it for about 3 or 4 feet, this is because of the super intendant not salting the entrance to the underground parking garage. so i am wondering, what advice should i give them? what do you do in a situation like this? is it the super`s liabillity or is it his, and should it be reported to the insurance company?

Also where can we go to replace this bumper of this 2000 Dodge Caravan Sport?

I do have some pictures of the damage done this morning, the fog light is still good in everyway the accident took the whole thing out of the bumper in its surrounding keeping it safe

doubt the apartment insurance will do anything.....needs to slow down a lil .bit

i figured the same thing, just suck it up cut the loss, i mean i just found a bumper on car-part.com for $50 and its only a couple miles away but i mean i guess its worth a try for them if they want to try to get it free, because the bumpers did range from $50-$500.....

Driver is responsible for being stupid. Nobody is liable for the damage but himself.

Try Cross Canada for a bumper. Or duct tape.

theres already duct tape on it not doing to well, but the fact that they dident salt a ramp is not the drivers fault

here in Ontario.. if it went right down to court. It would be the driver at fault. The Defense would argue that it's unreasonable to assume that the super/landlord can be out there 24/7 to ensure that upon the first trace of snow that they could be out there salting the ramp.
Also, I'm sure that if your friend looks at his rental/lease agreement they will find that what he signed also states that the owner of the building is NOT responsible for anything that happens to vehicles in the garage/lot, be it; theft, damage or accident.
The 'care and control' of the van was in your friends hands, regardless of the conditions, not within in the owner/supers control.

Regardless of all that.... if it was a slip and fall (meaning personal injury) they'd have a better arguement ... still not concrete.
Realistically though, for the cost to repair it's not worth the hassle and risk that he may lose and be stuck with lawyers fees and lost wages the day or days of court vs a new bumper.

I agree with all above. Its not their responsibility to salt the road ways. Shit happens get a new bumper or call the insurance and go on about yo bidness.
