Does he work for a company? Or is this just some guy your hired to build the garage?
If he works for a company and its not an LLC than the company is responsable not the individual.. and you can sue his company (even if he no longer works there). But if its just some joe blow off the street than there is nothing that can be done and that really sucks.
Wow if that is the only criteria to be forced to pay, I need to move to your state, take loads of money and say I do not own property. That does not sound right. As stated above they should be able to garnish wages. Good luck and I hope you can recover from this big loss of money. With this kind of money I would recommend a second opinion.
you should be able to put a lean against him. if he ever tries to get a loan to buy a house or a car or anything like that, when they run his credit report it pulls a red flag cause he owes someone money and is still pending. if he ownes any property such as a car, typically, you can have the car impounded in payment of the money. at least thats how it worked when we had some dirt bag renters in a rental house we used to own. they owed my dad like 3000 we filed for a lean, their car got impounded if they wanted it back they had to pay us then the for the impound or let us have the car in lue of payment and they still had to pay the impound fees. just a suggestion. i would do as stated above, find a better attorney.
ok well went to the magistrate today to file a civil case ends up he is wanted for more then just ripping me off so now instead of a breach of contract its a breach of trust and recieving funds with intent to defraud...so his ass is going to jail..got that muther fucker now just gotta get my money
