--------------------------------------------------------------------------------ok heres the deal..my friend was workin at a shop, ended up owing the owner some money for work..anyway he had a nice toolbox at the shop and he was hurtin for money so he sold it to me. this guy moved away and is now in cali, and the shop owner is holding the toolbox hostage untill he says he gets his money..can he do this legally? what should i do to get it back, i will not pay some1 elses debt to get my own stuff back..thanks! i am in tx btw

What probably should have happened is your friend should have paid the money that you paid him for that toolbox to the owner of the shop and let him know that you have bought it. Basically, the owner can hold anything on that property until the bill has been paid and then after a certain amount of time, they'll have the opprotunity to sell it to try and recoup losses, or they'll just trash it.

I'd try to get ahold of the owner and your buddy and see what you can get going. Guaranteed though it's because your buddy didn't pay that guy any money from selling that toolbox. You can't sell something if it's not yours at the time, ie. past due on rent and its in the shop.

the circumstances were diff at the time, he needed money to move to cali and i thought the shop owner was a decent enough guy and friend to give me the box. turns out he is a douschebag

Though the time were different bro, he your "buddy" should have paid his debt, although the shop owner said he was going to give you the goods, he still didn't have his cash and still doesn't as far as we know, I know everyone needs cash, but the shop owner was nice enough to let the guy take his truck/car after the work was done with no money, then I would imagine the guy probably told the owner he would get him the dough when he got rid of the box, the owner spent his time working on the vehicle taking up his shop space that another paying customr could have been using, he's not the dickhead bro, I'd check on your so called "buddy"

i don't think the shop owner is at any fault in this matter, if your buddy owed him money, then the matter needs to be taken up with him, not the shop

WRONG! Unless there is some type of agreement, the owner cannot hold property for ransom pending payment. I will admit you'll have a hard time getting that box, even with police, cause it's a civil problem. The owner needs to sue your friend for the money owed in civil court.

This hapens all the time with landlord /tenant disputes. Landlords want to hold onto a tenant's property till back rent is payed..can't do it, at least in California.
