Maybe he won't even show up in the courtroom, that's how a lot of my friends beat little retarded tickets for pretty much doing nothing but being harassed..
They do that here though and I always thought it was illegal too, they hide behind signs and other cars with their lights off..
They also come flying out of intersections and almost slam into you, then get behind you and ride your ass for about a mile then pass you going about 90 in a 55 weaving in and out of other traffic (at night) with no emergency lights on. You can't tell me that's safe.. someone could be pulling out thinking everyone's going the speed limit, and then BAM there's the cop who's going 90 ramming into you..
I say fight it.. because even though I respect most cops and they do their job, on the other hand there are the ones who take advantage of the badge and do whatever they hell they want.
49 in a 35 zone. Got me right after the 35 sign.
I always fight any ticket I get up here in WA if the cop doesn't show up you win. I've got off so many that way and its worth a shot if you win great if you lose your still stuck with the same bill.
ok heres how to beat that. if he does decide to show up for court which most likely he will not ask him to see the records of when radar gun was last calibrated. was the trafic on the street heavy? radars shoot in a v pattern so if there was someone next to you claim it was them.
Whoever said that its "entrapment" needs to look up the definition of entrapment. Its probably the most over used defense I ever see and if you go to court with that, then the judge isn't even going to listen to you. Entrapment only occurs when a peace officer positions you to commit a crime that under normal circumstances you would not commit.
Law enforcement can can hide wherever they want to and "trap" anyone that may be breaking the law on their own free will.
However, if you have the time to deal with it, then I would suggest going to court and just explaining your point of view and focus on why you didn't realize you were speeding due to the zone change because you were unfamiliar with the area and the zones there. You might at least get a reduced fine or if the cop doesn't show you win by default. If it were closer like 40 in a 35, then you could possibly bring up equipment calibration, but I doubt any judge is going to believe the equipment was off by 15 MPH. Sometimes you can not go to traffic school after pleaing not guilty, so you need to check into that and decide what's more important in the long run.
Each State is different when it comes to that law. Idaho they can do that all they want. Infact some officers will back into the underpass ramp and just sit up there clocking.
In Oregon though they have to have there park lights on at least. Just check your State traffic laws.
Just move to Canada and change your name to Stephanie.
In all seriousness check the laws but in the end goto school and write it off as a learning experience.
Good luck man.
just keep reschedualing the court date as many times as you can and by the last time he will get sick of showing up for nothing and most likely will not be there. i have seen a bunch of people get out of tickets this way
